About China's Imported Food Regulations
On April 12, 2021, the General Administration of Customs of China (GACC) released two decrees, namely GACC Decree 248: Regulations on the Registration and Administration of Overseas Manufacturer of Imported Food and GACC Decree 249: Administrative Measures on Import and Export Food Safety, both of them will enter into force on January 1, 2022.
Decree No. 248 requires all overseas food manufacturers, processors, and storage facilities (hereinafter as food manufactures of imported food) to register with the GACC through official-recommended registration or enterprises’ self-registration according to food risk levels. For the overseas manufacturers producing 18 categories of specific food, the competent authorities of the country (region) where they are located shall assign their registration system account number and submit their application materials to GACC for review. The overseas manufacturers of food other than those 18 categories can apply for the registration system account number by themselves or entrust a third party agency to submit the application according to registration procedure.
Enterprises should pay attention to the fact that for food exported to China from January 1, 2022, they need to fill in the registration number in China at the time of import declaration. In addition, for food exported to China produced from January 1, 2022, the registration number in China or the registration number approved by the competent authorities of the country (region) where it is located shall be marked on the inner and outer packages of food exported to China.

Export and registration qualification check
According to Article 5 of Decree No. 248, overseas manufacturers of imported food shall meet the following four conditions:
- The food safety management system of the country/region where the producer is located (“country/region”) has passed GACC’s equivalence assessment or review
- (The manufacturer was) established with approval by the competent authority of the country/region, and (the manufacturer is) under effective supervision by the competent authority;
- (The manufacturer )has an established, effective food safety and sanitation management system and food defense system, legally produces and exports food in the country/region, and ensures that foods exported to China comply with relevant Chinese laws, regulations, and national food safety standards
- (Foods exported to China) conform with relevant inspection and quarantine requirements that have been agreed upon after discussion by GACC and the competent authorities of the country/region.
Therefore, overseas manufacturers should clarify if they have complied with above four application conditions before deciding to register with GACC.

Overseas food manufacturer registration
According to the provisions of Decrees 248 and 249, all overseas manufacturers of imported food shall register with the GACC.
